Nabors, Giblin & Nickerson attorneys Gregory T. Stewart, Carly J. Schrader and Lynn M. Hoshihara representing Nassau and Okaloosa Counties were successful in invalidating the Department of Juvenile Justice’s cost sharing rules in a decision issued by the First District Court of Appeal.
The Firm had previously been successful in invalidating the Department of Juvenile Justice’s cost sharing rules before the Division of Administrative Hearings. The First District decision affirmed that determination.
The rules being contested shifted significant costs of secure juvenile detention to the counties beyond what was authorized by statute. The decision has the potential of reducing the cost to all counties throughout the State of Florida. A copy of the Final Order entered by Administrative Law Judge W. David Watkins and the decision of the First District Court of Appeal are available here.
